Terms & Conditions

One-Day Intensives with Jennifer Westbrook

By acknowledging and affirming this Agreement, you ("Client") agree to retain Jennifer Westbrook of JenWestWriting ("Service Provider") to perform business services for a copywriting, website design, or systems integrations intensive, packaged under any "One-Day Intensive" or "VIP Day" with Jennifer Westbrook, and agree to the terms and conditions as set forth in this Agreement.

Services & Payment

​

Intensives are exclusive bookings on a specific day at a specific time for a specific number of hours. Intensives ensure dedicated time will be reserved to perform business services for Client without interruption.

​

During the one-day intensive, Service Provider agrees to devote up to seven hours on projects to be determined by Client, as well as 45 minutes for a pre-intensive kickoff call, one hour for post-intensive "fix" support (available for 24 hours after the intensive), and 30 days of post-intensive technical support by email. The duration of a half-day intensive is up to four hours, and the duration of a five-day intensive is up to seven hours per day.

 

Work will be performed at the offices of Service Provider, but occasionally may take place at other locations, as required. Work priority and scheduling will be at the discretion of Client. Work will normally occur between the hours of 9:00 a.m.–5:30 p.m. Eastern on weekdays and Saturdays. No work will be performed on Sundays.

During the 24 hours of post-intensive “fix” support, the Client will be able to email Service Provider with any requests for minor revisions or changes to the work that was performed during the intensive and will receive a reply via email. If the scope of support requested exceeds what Service Provider can complete within one hour, Client will have the option to book another full-day or a half-day intensive. The amount of time required to complete “fix” support requests is at Service Provider’s discretion.

 

During the 30 days of post-intensive technical support, the Client will be able to email Service Provider with any questions or concerns about the work that was performed during the intensive and will receive a reply via email. This technical support does not cover additional copywriting, website, or systems work that exceeds what was done during the intensive. If the Client has additional work that needs to be performed, Client will have the option to book another full-day or a half-day intensive.

Services in addition to the intensive will be made available by Service Provider at the current daily or half-day rate and will be billed separately. Any expenses exclusive of normal overhead are not included in this Agreement and will be billed separately. Examples of such expenses include but are not limited to stock images, premium font licenses, website domains and hosting, and third-party application services.

 

Payment in full is required to reserve an appointment. Payment for these services will be to Service Provider at the rate of $2,000 per day or $1,000 per half-day and will be due at the time of booking this appointment.

Once Client has reserved an appointment for an intensive, Service Provider will not accept any other work from other companies for the dates and times of Client’s intensive.

 

As a result, once an intensive is scheduled, if it is subsequently rescheduled or canceled, the payment terms will be governed by the Purchase Terms, Scheduling & Termination provisions of this Agreement, which are as follows:

Purchase Terms, Scheduling & Termination

 

This purchase is non-refundable but may be transferred to another date or service with seven days' prior written notice.

 

In the event the Client fails to complete the pre-work or Workbook within 24 hours of the booked appointment, the Service Provider reserves the right to cancel or reschedule the intensive.

 

The Client's payment is valid for 90 (ninety) days and must be used within that timeframe. In the event the intensive fails to occur within 90 days, or the Client fails to request a new date at least seven days prior to their booked appointment, the payment will be forfeited, and the intensive will be terminated. If the Client wishes to reschedule beyond 90 days, the original payment may, at the Service Provider’s discretion, be applied to a new booking at the current intensive rate, which may or may not be higher than the original booking rate.

Nature of Intensives

 

The Client understands that an intensive is the purchase of a block of time on Service Provider’s schedule. While all reasonable care will be taken to ensure that the work requested by Client is completed to the highest achievable standard, the Service Provider does not guarantee full completion of any tasks or deliverables during the timeframe of the intensive.

Intellectual Property & Ownership of Deliverables

​

Client is responsible for all trademark, service mark, copyright and patent infringement clearances. Client is also responsible for arranging, prior to publication, any necessary legal clearance of materials Service Provider uses for this project. Client indemnifies Service Provider against any loss or damage arising directly or indirectly from any unauthorized use of photographs, text, content, or other Intellectual Property not under copyright ownership of Client.

The completed deliverables resulting from any and all work performed by Service Provider for Client, including original creative work, will remain the property of the Client, and Service Provider hereby assigns such rights to Client. Client may use this material in any way deemed appropriate.

Promotion

​

Client understands that any written statements, images, audio recordings or video recordings of Client while participating in the intensive and made on behalf of or in reference to the Service Provider may be used in connection with publicizing and promoting the Service Provider. Client authorizes the Service Provider to use Client’s name, brief biographical information, and the written or recorded statements. For website design services, Client agrees to allow Service Provider to retain a credit and link from the footer of the website. Client further authorizes the Service Provider to use Client’s website, associated graphics and any unused ideas and development in the promotion of Service Provider.

Limitation of Liability

​

In no event will Service Provider be liable for any special, indirect, incidental, or consequential damages nor loss of data, profits or revenue, cost of capital, or downtime costs, nor for any exemplary or punitive damages, arising from any claim or action, incidental or collateral to, or directly or indirectly related to or in any way connected with your purchase or project.

Independent Contractor

​

Your purchase does not create an employer and employee relationship, a master and servant relationship, or a principal and agent relationship between you and Service Provider. Your purchase acknowledges that you agree that Service Provider is, and at all times during your project shall remain, an independent contractor.

  

By purchasing an intensive, you acknowledge that you read, understand, and agree to the Terms and Conditions above.
